Child custody forms Essays Child custody forms Essay Child custody forms Essay Divorce issues Response to an Affidavit in Opposition Motion Why the Father is Not Resolving Issues One of the most contentious problems in a divorce is child custody, and a child, in this case, is defined as someone below the age of 21 years according to the Womens Charter. At times the child is taken to the counselor who is responsible for taking care of the child, especially for help in psychological matters affecting the child as a result of the separation of the parents. Despite the spouses divorce, both of the parents still have the authority when it comes to deciding on the main issues affecting the childs day to day matters. The parents acquire full control of the child when in their custody. In my case, my ex-husband and I have joint custody and complete control of our child Trevor, but the problem is that he is not helping in correcting the issues that we are facing. Instead, he blames me for all mistakes without finding out the reasons as to my behavior. Solving of Issues in divorce decree Right and Wrong Increasingly, the courts have been giving custody of the children to both parents. The reason for joint custody is for the good of the child. The presence of the two parents in the life of the child is significant for development or rather crucial support to the child. Just because the marriage has ended, it does not mean that parenthood stops altogether. In this case, I feel that my ex-husband has been assuming all the responsibilities and major decisions about the welfare of our child. There are several issues that he has not resolved, and they affect our son and me adversely. Despite not correcting issues while he has the custody of Trevor, other problems have emerged which have prompted me to respond to the matter at hand. As the other partner with a responsibility to my son, I have a right to defend my custody of our son, which is aimed at improving his welfare. It is also wrong that my ex-husband has been taking the side of my son, especially when he goes complaining to him after I have disciplined him. As a parent, I know how important it is to teach a child since it contributes significantly to his growth, development and training in the later life of adulthood. I have been trying to learn and educated Trevor to my level best. However, when Trevor is in the custody of his father and complains of how I discipline him, the father takes his side. He forwards the complaints to his lawyer who then contacts me in an unfriendly manner. Most of the children are not in support of the disciplined measure imposed on them and would thus lean to the side where the discipline rules are not stringent. This is the same case that has been happening with my son since he does not approve of my discipline measure. Despite my effort in trying to bring up our son in an upright manner, my ex-husband has been pointing fingers at me and blaming me for making our son unhappy. He puts forward the blames without even doing a thorough research on why I had to discipline Trevor. For proper child bringing, the parents need to join hands and ensure that their children are well-behaved instead of putting the blame on each other. My ex-husband has been doing the contrary of what was expected, and I feel that this is very wrong. I have a right to discipline my son by the law. Additionally, it is very wrong that my ex-husband cannot punish our son all in the name of wanting to win him over and make me look bad in the eyes of my son. He should perform the responsibility of a parent and instill the necessary education and discipline required of Trevors upbringing. It would only be right if my ex-husband would stop the blame game regarding the custody of our child. Neither of us is perfect, thus instead of playing the blame games, we should have a serious talk on the upbringing of our child. He should contact me to establish the facts on why I decided to discipline our son in the manner in which I did, and from there we can agree on several ways of doing the disciplinary and the education. His avoiding disciplining Trevor does not do any good. Consequently, lack of proper upbringing will haunt us later in life as the parents. It would be a greater disappointment when Trevor reaches an age where it would be hard to teach him to the right path since we ignored to make the changes while he is still young. Code of conduct definition Offensive and Defensive Breach of Conduct by the Counselor Code of Conduct outlines the acceptable ethical issues and workplace behaviors that the employees in any given position should adhere to diligently. The formal document clearly describes what the employees should and should not do. As a result of the breach of the code of conduct, the employee should be eligible to penalties of equivalence to and level of the contact breached. The kind of the offense that the counselor in charge of my son committed is categorically a primary offense, and thus severe measures should be enforced. Not only did she abuse her power by trading off the sensitive medical report of my son to his father without my knowledge, but also informed me that I had to pay $10, 000 if I wanted the medical report that should be handed over to me even without asking for it. Thus, she has to face the full force of law by violating her job conducts. A counselor was given the responsibility of counseling our son when he was in the custody of his father. Her responsibilities were to make all the decisions about Trevor more so health-related decisions. The decision the counselor was to make were inclusive of the daily care of Trevor, help him manage the parent separation issues, his health care, and general behavioral correction. However, I have lost faith in the counselor, and I now know that she is not capable enough to look after my son appropriately. She was given the responsibility to take care of all the needs of our child and act according to the set codes of conduct, but she breached the ethical and professional conduct. I have exhibits that the counselor saw Trevor cry for the whole of 2016, but she did not inform me on any of this. The crying of the children can do more than the public harm, not only to their health but also for general growth. The prevention of mind relaxation, loss of appetite and depression are among the negative impact that is associated with the continuous crying. Additionally, when a child cries especially for a prolonged period, then that implies that there is something vital to him that is not being provided. With the maternal instincts naturally instilled in me, crying of the child continuously can be stressing, and more so when the child is not in my custody. I could not stomach the look on my son when I know he had been crying all through under unknown circumstance. Whenever I see his dark face, I cannot help but cry too. Thus, I thereby feel that the counselor appointed for my son failed terrifically in her duties and thereby should get offloaded her obligations and the child handed over to a better guide who can act and perform these duties as expected. The right to have access to medical care Another reason why the guide has failed in her duties is that she did not at any one time listen to the pleas and complaints that Trevor had been presenting to her. It is the right of my son as a true citizen of this nation to have access to medical health. His complaining to the counselor was a clear indication that something was eating him up, an ailment that could be treated but the guide chose not to recommend a medical practitioner and concealed the information from me for reasons only known to her. Being denied access to health care is the worst thing that can happen to a helpless child who could not get access to life necessities just because the mother had no custody of him. Therefore, the counselor should be offloaded the burden of my son since he is on the verge of something risky happening to him as he could not be provided with medical attention needed. I have the interest of my son at heart, and I would gladly give him the life necessities like access to care as his moth er. Not only did the counselor fail by making my son cry his eyes out for a whole year and denying him his right to access medical health, but she also collaborated with my husband to leak personal and private information about my sons health without my consent. My ex-husband had access to this sensitive information for free, and he did not tell me about it, yet we all have a part to play in our sons life as per the terms of the joint custody. To blow everything out of proportions, I was asked by the same counselor who acted behind my back with my ex-husband to pay a huge lump sum of money amounting to $10,000. Honestly, if it were for a good course, I would gladly work myself off to raise the price. However, the strange thing is that she was asking me to pay that entire amount for information that should be relayed to me way before even asking for it. The maternal care in divorce Fair and Unfair As a mother, I have a right to know what my son is ailing from and act appropriately as per my duties as a parent. By the end of the day, I would be the one to lose just in case anything terrible happens to my son. The fact that my ex-husband could access the information is unfair since we all have equal rights to access the information about the health and welfares of our son. The counselor should face justice for acting in a biased way and favoring my ex-husband by having him obtain the medical report of our son. I protest the continuity of the counselor taking care and being in charge of my son since she does not have the best interest of my child at heart. If it is not possible for me to be granted the full custody of my son, then I would be more appropriate if the counselor could be swapped for a more caring and code of conduct adhering counselor. It is also unfair that Trevors father has enrolled our son in a competitive baseball league and some summer league ball and swim club. It is very fair when my son gets to engage in creative activities like these, but the wrong thing is the timing of the events. His father has made sure that these activities coincided with my days of custody of Trevor, and this is way too unfair on my part as these activities deprive Trevor and erode his time with his mother. This is not appropriate behavior, and the father should be reminded of his wrongful actions and it should be stopped immediately. His desire to enroll Trevor in these activities is all for selfish motives of wanting to widen the gap between my son and me. These activities have eroded two of my custody days, and to make the matter worse, my ex-husband never consulted me before making that decision. He is only after hurting me when he does that, and this is not fair at all. Once I discovered that Trevor needed emergency treatment, I put all the input measures in a position so that I could attend to the health matters of my son enough. I consulted a doctor on the issue to have Trevor start medication right away. However, instead of this issue being taken with the weight it bears, Trevorts father denied my input on the issue. He went ahead to discuss my concerns and complaints with Trevor who does not even know what is best for him since he is just a kid of ten years. My efforts of attending to my childts heath were not appreciated or acknowledged at all in this particular moment. The consultant in 2014, Bob Finlay, who initially discussed this health matter with my ex-husband Andrew, suggested that Andrew hires Sandy Hawkins to treat my son. That was a humiliation of the highest level since and my effort to cater for my childs health was trashed away and disregarded as worthless. Animportance of child safety Having swapped my doctor for his, Andrew should not have compelled me to pay for the other half of the medical services provided to our son. He disrespectfully disregarded my doctor. Thus Andrew should be the one to cater for the recurring expenses since he saw my ideas as worthless. It would only be fair if he consulted me so that we could collectively agree and take our son to the best doctor. The competition that he was trying to pose was totally out of place and unhealthy, and it directly has adverse effects on our son as he had to see daily when his parents keep on fighting even for very simple matters. Communication is important, and in this case, a simple consultation would have been good for me all the right for our son. Thus, I at this moment feel that the unhealthy competition Andrew poses to me has already affected our son to a great extent, and he should be denied custody till the time when he knows the value of the care. Safety of our child should come first before our differences. Having him have a say, I matter that are way beyond his age is precarious and could have severe consequences if we give him the mandate to decide on what is best for him. Having Trevor enrolled in the competitive sports is way too risky for his tender age. Additionally, having to see us disagree on everything especially matters that are sensitive to him like his health is not only unsafe for him but us too. Thus, it would be safe we put aside our differences for once and have the essential matters attended to adhesively. Having a child lose faith in their parents is very disappointing since he may conceal important information from them which may have to severe implications later in the future. Both physical and emotional safety of Trevor is vital hence Andrew should face the law when he tries to mess around with these facts. Family conflict Safe and unsafe Why the Father Is Not Resolving Issues I disagree with the idea of sharing custody of my son with my ex-husband. With my ex-husband having the care of our son, I feel that Trevor is rather unsafe by having his father as part of the care. He has not changed or corrected his behavior of being over protective and failing to discipline our son, and this is a major risk for our son. His kind of behavioral conduct is not fit for our son since it would be bad for him to grow while morally crooked. Not only can he emulate the behaviors of his father but can it can also end up affecting him negatively since he has an emotional connection with his father whereby he is on the verge of believing that everything his father does is always correct. Children are too quick on picking up behaviors from other people whether good or bad, and it would be unsafe for him to have his father as a role model since he will need to man up and discipline his children when he grows up. Andrew has been actively aggressive over the recent past trying to destroy my relationship with my family and friends, and he has been doing this by turning them against me making them believe that I am a terrible mother to my son. He has a psychologist for a sister who can is capable of advising him according to over the issues we are facing at the moment. Andrews maliciousness started way back after delivery of Trevor has he would start fights once he arrived home from work. He has a deep history of rage issues as a fan of multiple sports teams, and I have witnessed Andrew go through withdrawal when the Canucks contract agreements go haywire, and he does not have the ability to focus on the television and follow the games. His family too had had family feuds as he suffered a lot when his mother, Jane James, and her brother were distanced for over 30 years as a result of a family feud, and it was not until her passing that her immediate family communicated with him. Andrew has thus been affected greatly and wants to pass this predisposition on Trevor. As the mother to Trevor, I cannot allow my son to go through the family feud stress. Thus, I would do anything legal to protect my son. Joint custody with ex-husband Joint custody was meant to give my ex-husband time to rectify his behavior, but that has not been the case. Since my ex-husband has failed to correct his behavior, then he should know I should be given the full custody of my child to keep his actions in check solely. It was very offensive and against the law for the ex-husband to go beyond my back and obtain the medical report of our child without being informed immediately as well, my sonts health care has been delayed far too long. Our son is our priority, and we both have equal rights to know what our son is undergoing. He being given a chance to access information that I was delayed informed we had to pay huge sums to obtain. We both should regularly be informed on the medical state of our son with no costs attached whatsoever. Additionally, it was unfair that it took a whole year for me to get informed on the medical issues of my son. As a woman and a mother, I have equal right as my ex-husband, and so is the manner to the acces s to report that he too has access. The court should thus use this incident to analyze and serve justice in this case. It is very unsafe to give power and mandate to a child to decide on sensitive matters like their health issues. The act that Andrew had to consult Trevor on my complaints about his health is not acceptable. As a mother, I have the right to decide on what treatment my son should undergo since I know what is best for him. Andrew having to consult with Trevor clearly indicates that my opinion is not valid at all. Additionally, he portrayed a bad image in my sons head by having him have a better say than mine when he consulted Trevor than believe what I had to say. Respect is equally important, but in this case, Andrew humiliated me in the worst way possible. I have a right to be treated and coded all the respect I deserve and not be disrespected for any reason at all. It would be reasonable for him to talk things over before behaving disrespectfully. Dispute resolution The disputes that my ex-husband and I have been having needed to be solved with immediate effects before things get out of proportion. Most of the complaints that I have put forward results from my ex-husbands aggressiveness to bar me from being with my son. joint custody means that we all have equal right to be with our son. Thus he should let me have my time since I do not interfere with his time with Trevor. Since he has proven to be more aggressive and challenging for me to handle, I would, therefore, ask for the intervention of the court in this matter. He has subjected me to mental stress which has caused me anger as it is very difficult to parent as a result of these actions, and this affects my health in general. I still need to have mental and health stability so that I can play my role as a mother to Trevor. He is a young child, and his well-being and welfare are my priority in my lie. Parental responsibility Problem Solving The problem that I am having with my ex-husband can only be solved by having stringent laws govern the time we have with our son. He should not interfere with my custody time for whatever reason. If he needs Trevor to engage in any extra curriculum activities without consulting me, then he should do so within his custody days and not mine. Additionally, Andrew should establish facts before pointing fingers and blame me for disciplining my son. He too as a father has a responsibility to teaching Trevor, and if this is too much for him, then I should be given full custody of Trevor. His malicious aggressiveness should be evidenced enough of him being denied the care of Trevor since he has breached the terms of the contract pertaining the contract. As a mother, I should not be subjected to any pressure since I still have a long way in bringing up my son and this would not be possible with the kind of pressure that his father has made me undergo. In summary, I am requesting for my husband to help in correcting our sons behavior and guiding him appropriately without taking the sons side to win him over. I would also appreciate if my ex-husband can assume the responsibility in making crucial decisions regarding the welfare of our son. Additionally, I am suggesting the replacement of Trevors counselor because she is biased and has failed by breaking her ethical code of conduct. She is taking advantage of the situation to demand huge sums of money in trading for our sons information, which is one-sided. I am also proposing that she face the law for her misconduct to avoid repetition of such actions. I am supporting the idea that Trevor should engage in physical exercises such as the ones his father registered him. However, such decision should be made by both of us, and they should not affect our time with our son. I am willing to take full custody of our son in case my ex-husband is not ready to take parental roles seriously. Co rrecting the behaviors of a child is one such a central role that each parent should play. If the father does what the child tells him rather than having the son do what the father says, then, Trevors morals might be corrupted, and he might live a regrettable life in the future just because of someone who failed his role as a parent. Finally, I would like the law to take its course so that my ex-husband will not continue subjecting me to mental stress by barring me from being with my son.

The Sendai Mediatheque had been partially damaged during the 3.11 earthquake, Ito told Maria Cristina Didero of domus magazine. To the citizens of Sendai, this piece of architecture had been a beloved cultural salon....Even without a specific program, people would nonetheless gather around this place to exchange information and interact with one another....This led me to realize the importance of a small space like the Sendai Mediatheque for people to gather and communicate within disaster areas. This is the starting point of Home-for-All. Every community has its own needs. For Rikuzentakata, an area devastated by the 2011 tsunami, a design based on natural wooden poles with attached modules, similar to ancient pole or pile dwellings, was exhibited at the Japan Pavilion of the 2012 Venice Architecture Biennale. A full-scale prototype was built onsite in early 2013. Itos public service work with the Home-for-All initiative was cited by the 2013 Pritzker Jury as a direct expression of his sense of social responsibility. The number of aboriginal women in prisons is higher than that of men, which shows discrimination against them. When Europeans arrived, aboriginal women were even deprived of their right to vote. Their children were sent to residential schools at very early ages, to return after many years or never to return. Likewise, lesbians have been facing discrimination in Canada since a long time ago. They have been treated as psychologically ill persons, and are often subjected to electroshock therapies. They have not been allowed to get admitted to armed forces, and have been facing sexism at workplaces and public places. They have also been victims of anti-lesbian violence and discriminatory Canadian laws. For example, before 1969, lesbianism was considered as a crime in Canada, and was offensive enough to lead to imprisonment. Aboriginal resisted the deprivation of their right to vote, enter into business contracts, and own property. They struggled hard in the twentieth century to make themselves recognized as legal citizens of Canada. Due to their struggles, only some decades ago, law recognized them as legal persons and lifted precincts upon their right to vote, enter into contracts, and own property. They fought for their equitable position at the constitutional table. Similarly, today Canada has many national laws that protect the rights of lesbians, and imposes fines and punishments on those who do or provoke anti-lesbian hatred at workplaces or public places. For example, the Canadian Human Rights Act was designed after lesbians raised their voices against discrimination against them. This law â€Å"forbids discrimination based on sexual orientation by federally-regulated employers, landlords and services† (Sexuality Information and Education Cou ncil of the United States, 1999, para.6). To conclude, aboriginal women and lesbians have been raising their voices against the marginalization that they have to face due to hatred of the society. Many laws have passed, and many associations are working, to protect their rights, but still their suffering has not completely ended, and they are considered as mentally ill and inferior persons of the society. 2. Feminism has seen four waves since feminists, and women themselves, have started raising their voices against gender discrimination they suffer from at homes and at workplaces (Rebick, 2005). Evaluation Proposal Essay Abstract The driving force that stimulates the founders and leaders of the program LAs BEST to aggressively seek evaluations for the program is its genuine concern to be effective and efficient in delivering the goals of the program to disadvantage children, rather than a legislative requirement. The managements initiative of professionalizing practitioners in the after school program, particularly the staffs will make a significant impact on LAs BEST, because these individuals   are the key players in the implementation and overall support system that the program provides for the disadvantaged children participating in this after school program.    As the staffs are the ones involved in giving custodial care and making the learning environment/activities more engaging for the children.   There are many evaluations that were done for after school program as discussed by Scott-Little, Hamann Jurs (2002, p. 394); usually it is the children that are evaluated. Yet for the program to be effective, there is a need to evaluate the staff. This evaluation proposal is being submitted to meet that need, a methodological research has been designed to gather information that will guide management to create staff development sessions that will affirm and promote best practices for the program. It was also designed to gather perceptions of professionalism of the staff and to articulate the core knowledge and skills required by staffs in after school programs and how these may be acquired and updated, as well. Introduction   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚     In 2002, Congress passed into law the No Child Left Behind (NCLB) Act of 2001.   The passage of this act has significantly amended the Elementary and Secondary Education Act to expand State and local accountability and flexibility, and to stress the adoption of research-based practices. (Mahoney Zigler, 2006)   It also contained a number of new provisions that specifically affected the program of 21st Century Communities Learning Centers (21st CCLC) that was authorized under Title IV, Part B, of the Elementary and Secondary Education Act (ESEA). It gave the States the responsibility to focus on the 21st CCLC program with specific purposes;   (1) to provide opportunities for academic enrichment, particularly to students in high-poverty areas and those who attend low-performing schools. And to help the students meet State and local standards in core academic subjects such as reading and mathematics; (2) to offer students a broad array of additional services, programs, and recreational activities, that are designed to reinforce and complement the regular academic program of participating students; and (3) to offer families of students served by community learning centers opportunities for literacy and related educational development. At the same time, centers help working parents by providing a safe environment for students during non-school hours, or periods when the school is not in session. (The Law, 2006). Description of the Program It was in 1988 (Factsataglance.2.doc, 2007) when former Los Angeles Mayor Tom Bradley created a program to address the growing concern of the community regarding the alarming increase of violent crimes that are mostly attributed to street gangs; the rising numbers of school drop outs, and the proliferation of illegal drugs being used by minors. In the belief that it was the city’s fundamental moral obligation to help these individuals, Bradley created a 55-member Mayor’s Education Council, consisting of leaders coming from the business, education, child care, government, entertainment and industry sectors of the community.   These leaders were tasked to structure and implement the program which was called LAs Better Educated Students for Tomorrow or LAs BEST.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   LAs BEST is an innovative after school program that provides a safe and supervised learning environment for children ages 5- 12 years old immediately after the close of each school day until 6pm without cost to parents.   Working parents of inner-city children, particularly those belonging to the low-income family groups, are anxious about the safety of their children during the hours after school day. As explained by Riggs Greenberg (2004) these hours are considered high risk based on studies of previous researchers, especially if minors are left unsupervised.   Many parents fear their children will be exposed to and /or be influenced by people with destructive behaviors exacerbated by poverty.   And the children themselves have expressed their fears and threats on their well being in their immediate environment or neighborhoods when interviewed according to Huang, Gribbons, Kim, Lee Baker (2000, p. 20). Goals of the Program   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The LA’s BEST program has been designed to provide custodial care, and to provide activities to meet specific educational, social, and motivational goals. (Huang et al, 2000) The program’s goals can be concisely summarized as; 1) to provide a safe supervised environment for the participants during the hours after the close of each school day until 6pm, and 2) to develop the learning experience of the participants through a positive support system in place that would address the participants’ academic, social and motivational needs. Brief description of the theory behind the program The theory behind the program is that when caring, responsible adults are connecting with the children in the hours after the close of each school day, these adults make the place safe to be for the children after school, and make the learning environment and activities more engaging for the children, and are considered as a key player in making a positive impact on the children’s academic achievements, enhanced social skills and emotional maturity. And in order for a program to deliver high quality service, priority should be given on professionalizing and training the staffs involved in the program particularly to the staff that will provide custodial care and learning activities to the children. Description of the Client With this in mind, this program evaluation is being done for LAs BEST with the aim of giving management an overview of the current skill level within the after school program of LAs BEST commenting on both skills, experience and training undertaken by staffs providing custodial care and learning activities to children. Information will also be gathered on employers expectations of skills needed by the staffs employed in this program both at present and in the future. The reason that this information is being gathered is to determine if there is a gap between the current skills level and the duties required to competently manage and implement the program. The information from this evaluation will be used to identify priority areas to be addressed in a proposed Staff Development Framework that LAs BEST wishes to develop. Evaluation Methodology Evaluation/Research methodological design employed Research for this evaluation will be conducted in two parts, the first part being; 1) a literature review of information available from LAs BEST commenting on current skill levels of the staffs providing custodial care and learning activities to the children. The literature review summarizes findings of research to be conducted into training, qualifications, and skill levels of the staffs in LAs BEST, 2) Informal interview of participants while gathering the literature review and, 3) Observational research commencing on site selection and interaction with participants. The second part will be the survey proper using the structure questionnaire for the skill audit survey; 1) gathering data from managers/supervisors participants and 2) gathering data from staff participants. Implementation measures The literature review summary will supplement information drawn from the second part of the research, the skill audit survey and, combined, will give a more accurate view of the current skill level of the staffs. The second part of the research for this report will be conducted through a targeted survey of managers and supervisors in LAs BEST and their respective staffs.   A survey of eight questions concerning the skills of staff in relation to the duties they perform will be gathered from the managers and supervisors. While another survey of 14 questions will be gathered from the staffs. Outcome measures Findings from the two areas of research will be contrasted to find notable areas of commonality and discrepancy and the results of this comparison will be included in this evaluation. Data collection and data entry The data collection tools that will be used in this evaluation are; 1) existing data or statistics from record files of LAs BEST that would yield demographic information as well as other personal data of the participants, 2) direct observation of participants during surveys and actual on site visitation, 3) survey questionnaires, and   4) informal interview. All surveys are structured to provide information on two major areas: how the managers/supervisors view the staffs; and how the staffs view themselves with regards to, 1) the knowledge and skills needed by after school staffs; and 2) the degree of professionalism of after school staffs.   All data collected will be documented. Data analysis and reporting Collected data will be analyzed through calculating percentages and descriptive statistics.   After data has been analyzed and interpreted, an evaluation report will be prepared comprising of; 1) an executive summary, 2) an introduction which describes the program, its components, the target population, and the goals and objectives of the program, 3) a methodology which describes how the program was actually implemented as well as how the data was collected, what instruments were used to collect the data and how the data was analyzed, 4) the results section of the data analysis containing concrete data, 5) a discussion section explaining how the data was interpreted, provides answers to evaluation questions, 6) discloses any problems or issues encountered in the evaluation,   7) suggestions on   what could be done in the future to improve other similar evaluations, and 8) a recommendations section where recommendations are made based on findings. Study Timeline The overall project management timeline of the evaluation proposal is presented in the table below (see Table 1).   The appropriate timelines for each task within each evaluation phase is also specified.   Our goal is to begin the evaluation in May 2007 and conclude with the final reporting in October 2008. Richard Connell's "The Most Dangerous Game" is a very exciting story of a manhunt. This story made me think about the morality of hunting: Humans are the cleverest creatures on earth, but does it give them a license to kill the other animals and even human beings weaker than themselves? I give below a short summary of the story to set the scene and then I will explore the ethics involved in hunting as a sport. "The Most Dangerous Game" presents the story of a hunter, General Zaroff, who finds hunting human beings as the most dangerous and fascinating sport. He likes hunting humans because human beings, unlike the other animals, can reason better and so provide a richer thrill for the hunter. He does not think hunting human beings is an immoral act because he believes in the theory of might is right and that the strong have the right to kill the weak. However in the story General Zaroff fails to hunt down Rainsford, who had the ill fortune to accidentally slip overboard a yacht and swim to the shore, seek shelter in the General's chateau in the midst of a jungle, and become General Zaroff's quarry for three days. Nevertheless, Rainsford, who believes it is immoral to hunt human beings, was clever and desperate--he gave General Zaroff the slip in the manhunt and killed the General. Analysis of the Poem “Bushed” Essay

The speaker’s journey throughout the poem is a transformation of his identity from the influence of the society to the dictation of his own self. The speaker tried to escape from the reality of his belief and identity. In the beginning of the poem, the speaker already established his purpose – to hide from the real world and obtain the illusion of aloneness. Yet he built a shack on the shore / learned to roast porcupines belly and / wore the quills on his hatband (Birney 4-6). He started building his life away from the world of injustice and pain. He tried to wake up with a feeling of contentment to make his life happy and ease the misery. The speaker mourns into his surroundings – a depiction of pain and suffering. The character of the poem is full of anxiety within his self. He bushed because he wants to disregard the things around him, his feeling of difficulty. By way of controlling the feeling of anguish, the speaker went to the wilderness and obtains all the emotions through the moon, mountain, and wind to be able to release what is hiding inside him – the dictation of his emotions to let go of the pain and move on once again. The poem is an irony of the reality. The author discusses the speaker’s journey and tiredness. As the speaker describes what he has gone through, he also discusses shows his life in the wasteland. The author attempts to make his poem a realization of contentment and real happiness in a world of simplicity. High School and Social Support Essay

The purpose of the study was to determine possible differences in leadership behaviors, using the Revised Leadership for Sport Scale (RLSS), between male and female coaches and among different coaching levels. The researchers submitted two hypotheses. The first hypothesis was that male and female coaches would respond differently to the RLSS in overall leadership behaviors. The second hypothesis was that differences on the RLSS would occur among coaching levels: junior high, high school, and college. The sample was nonrandom, including 162 coaches that were chosen on a volunteer  basis. Within the sample, 118 (0. 73) of the coaches were male, while 44 (0. 27) were female. With regard to coaching level, 25 (0. 15) were junior high coaches, 99 (0. 61) high school, and 38 (0. 24) at the college level. While this is a good sample size, the problem lies with the distribution of the sample. The sample number for junior high coaches, in particular, is rather low. A larger sample with regard to all categories would have aided in the data analysis, particularly when looking for possible interactions between gender and coaching level. The instrument utilized was the Revised Leadership for Sport Scale (RLSS) developed by Zhang, Jensen, and Mann in 1996. This scale is used to measure six leadership behaviors: training and instruction, democratic, autocratic, social support, positive feedback, and situational consideration. The scale uses 60 statements, which were preceded by â€Å"In coaching, I:† A Likert scale was then given for each statement: 1 = never; 2 = seldom; 3 = occasionally; 4 = often; and 5 = always. This produced an ordinal level data set. Scales were administered in a number of environmental settings: classrooms, gymnasiums, practice  fields, and offices. The internal consistency for each section was calculated: 0. 84 for training and instruction; 0. 66 for democratic; 0. 70 for autocratic; 0. 52 for social support; 0. 78 for positive feedback; and 0. 69 for situational consideration. There was no information, however, regarding the validity of the RLSS. A MANOVA was used to analyze the data for differences between male and female coaches with regard to leadership behaviors. This is not consistent with the type of data collected. The RLSS used a Likert scale (ordinal), yet a MANOVA would be most  applicable for normally distributed, quantitative data. The analysis showed there were no significant differences between male and female coaches in overall leadership behaviors. When the six leadership styles were examined separately, there was a significant difference in social support between males and females. In general, females scored much higher than did the male coaches. A MANOVA was also used to examine the data for differences between the three levels of coaching (junior high, high school, and college) with regard to leadership behavior in general. There were significant differences between the three levels. When breaking down the six behaviors and examining them individually, an ANOVA was used to analyze the data. Again, because the data for the RLSS is ordinal, an ANOVA is not the best analysis tool. The three coaching levels scored differently on three of the six behaviors: democratic behaviors, training and instruction, and social support. High school coaches scored much higher than college level coaches in democratic behavior. Junior high coaches were significantly lower in training and instruction than either high school or college coaches. Junior high coaches also demonstrated a lesser degree of social support than either the high school or college coaches. A MANOVA was again used to analyze the data for any interaction between gender and coaching level with regard to overall leadership behavior. Once again, a better analysis method could have been chosen based on the nature of the data collected. The results indicated no significant interactions. The ecological generaliziability for the study is fairly high. The surveys were mailed out, and returned on a volunteer basis. However, due to the nonrandom nature of the sample, the results would not generalizable beyond the 162 participants in the study. There was no effect size is listed for the study. In order to reduce threats to internal validity, the participants were asked to respond honestly and confidentiality was stressed so that the â€Å"coaches might feel more at ease in responding. † No other efforts were indicated. The researchers mention that the scales were given in a variety of settings. This could present a threat to the internal validity in that participants might not have been entirely focused on completing the scale, but instead on coordinating practice, completing  paperwork, etc. There are a number of other factors that could effect the internal validity of the study, yet were not addressed by the researchers. Coaching experience would greatly effect the responses of the participants, yet this was not considered in the study. The gender of the athletes may be a contributing factor to the coaches’ responses. It is not unreasonable to suppose that coaches of female athletes, particularly at the junior high and high school levels, will demonstrate more social support than those of male athletes. The nature of the  sport could also be critical. Certain coaching styles are more applicable for individual sports (wrestling, track, and tennis) than for team sports (football, soccer, and basketball). The socioeconomics and population of the school itself could play a factor. Certain schools have better athletes and programs in a particular sport, while others may not be able to field a winning team. In addition, at the high school level, coaches are occasionally asked/forced to work with a program they have no knowledge of or desire to coach due to staffing  shortages. This could dramatically influence a coach’s response to the scale questions. The history of the program as well as the individual coach’s personal coaching history could greatly influence responses. If the program has had several losing seasons in a row, perhaps the attitude of the coach could be different than that of a coach who has recently won a state title. An additional set of questions regarding the personal history of the coach in question could have helped reduce many of these threats. With additional information, the  researchers may have been able to use a modified matching system when analyzing the results. By increasing the number of independent variables to include things such as coaching experience and gender of the athletes, the researchers could have reduced some of the potential threats to internal validity. In addition, bringing coaches together to a common setting could have reduced location threat. Coaches meet seasonally for clinics. Perhaps obtaining permission to administer the survey during these meetings would have been possible. It would have also been possible to actually go to individual  schools and meet with the coaches as a group to administer surveys. This method would have given a good cross-section of gender and coaching experience for a variety of sports. While the study has merit, the methods need to be re-evaluated. The power of the study needs to be increased by obtaining a larger sample size. The numerous potential threats to internal validity need to be addressed and minimized where possible. It would also be helpful to be given data regarding the validity of the RLSS. Without these, it is impossible to evaluate the potential meaningfulness of this study.

Juidical Review Essays - Supreme Court Of The United States Juidical Review In 1717, Bishop Hoadly told King George I, "Whoever hath an absolute authority to interpret written or spoken laws; it is he who is truly the lawgiver to all intents and purposes and not the person who wrote or spoke them (Pollack, 153)." Early sentiments similar these have blossomed in to a large scale debate over which branch of our government has the power to overturn laws that do not follow the foundations of our democratic system; the constitution. In this paper I will discuss the history of judicial review in respect to the U.S. Supreme Court, but more importantly, I will discuss the impact that judicial review has had on the Supreme Court and our system of government and the various arguments behind this power that the Supreme Court now possesses. The first instance that the Supreme Court showed its power under the cloak of judicial review was in the legendary case of Marbury v. Madison. In the confusion of leaving office, President John Adams failed to have delivered four commissions which he had made before having to surrender his power to Thomas Jefferson. In fact, the responsibility of delivering the commissions was left in the hands of John Marshall, the former Secretary of State under Adams, who was now the chief justice of the Supreme Court. When Jefferson took office, he refused to have the commissions delivered, and the case was filed by Marbury and the three other marshals that failed to receive their commissions. As the Chief Justice, Marshall wrote the opinion of the court by answering three questions concerning the case; did Marbury have a right to the commission, did Marbury have a remedy to receive the commission, and was a writ of mandamus the proper remedy to receive the commission. Marshall answ! ered yes to the first two questions, but said that the Supreme Court could not give him the commission he was entitled to through a writ of mandamus. Through this decision, Marshall not only asserted the power of the court with judicial review, but avoided a potentially devastating confrontation with the presidency in the early years of our fledgling government. Marshall was able to establish the judiciary's role in our government with this decision by answering the question that if the courts do not have this power, who does. The significance of the Marbury v. Madison decision is far reaching. Before the 1803 decision, the court had never really been a factor in our government, so much that the 1802 session was terminated by President Jefferson. The case established the Supreme Court's authority to review and strike down governmental actions that did not follow the Constitution. Marshall believed that although the framers of the Constitution did not explicitly write the power of judicial review into the constitution, it was what the framers intended. I will discuss this argument in greater detail later. After the Marbury v. Madison decision, the Marshall court enjoyed a new found power, but rarely found occasion to use it since most of the cases that were heard were rather trivial private law disputes. However, the court was able to hand down a number of important opinions interpreting various aspects of the Constitution. After Marshall's death in 1835, Roger B. Taney ascended to the chief justiceship. Taney, unlike Marshall, was a Jacksonian Democrat, and a strong supporter of President Jackson and his view of state's rights. It was Taney who passed down the infamous 1857 decision in Dredd Scott v. Sandford, which displayed the court's belief that blacks had no real Constitutional status and that the court strongly supported state's rights. Furthermore, the Dredd Scott decision worsened conditions for nationalists, and inevitably pushed our nation closer to civil war. After the war had ended, the court again found itself busy with a large caseload due to the many commercial and private disputes raised by the war. Chief justices Salmon Chase and Morrison Waite helped to reestablish Congressional power over the defeated South, but had little chance to use its power of judicial review during this time or repair. Ang Lee's 'chinese authenticity' in his transnational films - Essay Example ‘Crouching Tiger, Hidden Dragon’ has received criticisms by Chinese audience and film scholars concerning its authenticity as a Chinese martial arts film. Looking at the film, its settings and the locations are all Chinese and its source of material is a famous series of Chinese pulp novels of the early 20th century. Yuen Wong-Ping’s martial arts chemotherapy use in the film is an excellent tradition of cinema in Hong Kong. In addition, all its actors are ethnically Chinese including major stars in East Asia. However, despite all these features, the Chinese audiences do not seem to connect to Ang Lee’s vision. They feel that the film does not reflect Chinese culture. Criticisms According to Wang and Yeh (175), Chinese audience claim that the film contains all that is Chinese as well as exotic identity. Elements of westernization are present in the film despite a total exclusion of West form in the film’s narrative. Chinese culture is a traditional cu lture and therefore it is designed to stability unlike the western culture designed for change and growth. However, Ang Lee has made a blending of Western psychological drama and Eastern fiction hence making the movie hybridized. Chinese culture is a fictional one yet Ang Lee’s ‘Crouching Tiger, Hidden Dragon’ has some emotional attachment due to the styles employed in the film. Critics feel that the film should not have contained elements of westernization for it to qualify as a Chinese film. The film has failed to be a symbol of Chinese culture due to the intercultural viewpoint of Ang Lee. For example Ang Lee has also failed to bring out actual Chinese values in the film. Instead, he has made a mix up of the Chinese and western values in the film by allowing some of the characters to poses and capitalize on western cultural values. In the western culture, the pursuit of happiness and individualism are highly valued. On the contrary, Chinese culture values mora lity and collectivism over individuality, and condemns the pursuit of personal happiness at the expense of others. Taking Jen as an example, the western viewers are more likely to praise her because of her qualities of strong will, independence and strength. They are also likely to perceive her as being a free person. Coming to the Chinese audience, their perception of Jen definitely differs because of the way she brings out her characters of strong will, independence and strength contradicts the Chinese cultural expectations. Holding to a strong Confucian point of view, the Chinese have criticized her for being excessively cunning and morally corrupt. This is opposed to their views on Sulian whom they say she is noble and mature enough to control her feelings. According to them, this is proper of Chinese people (Wang and Yeh 177). Some audiences have complained that the use of special effects made the work too look fake and hence a misrepresentation of the actual situation in the C hinese culture and actual Chinese Kung Fu. The movie has been produced as a Chinese martial art film. This means that the language used by he actors, including the accent, should be clearly understandable to Chinese-speaking audience.
